Types of Arrest Warrants in Hamilton County

Alias Warrant

An alias warrant is given when the defendant refuses to appear in a court session for a scheduled court date before any plea has been made. Moreover, it can be issued when a defendant ignores to respond to a citation in person or by mail. Failure to appear before a court may lead to added charges.

Capias Pro Fine Warrant

 A capias warrant is issued when a defendant has a guilty judgment either via court appearance, plea, or arraignment in jail and then fails to pay a fine or complete some stated conditions within the required period. You can only resolve a Capias warrant by paying the fine whole or remaining in jail until you earn enough jail credit.

Civil Capias Warrant

A civil capias warrant is a particular order in civil court cases where the defendant continuously fails to comply with the judge’s orders. Civil capias warrants are also known as body attachments and Mittimuses and are slightly different from criminal warrants. The primary purpose of the civil capias warrant is to get an individual into court for a hearing.

Fugitive Warrant

A fugitive warrant is a warrant sent from another state when the suspect is believed to be in a local jurisdiction.

Search Warrant

search warrant is a written order issued by Hamilton County courthouse officials ordering the search of a particular location for evidence of an offense. Law enforcement officers obtain search warrants by providing a probable cause of crime at the place to be searched or that evidence of a violation can be found. The Hamilton County Courthouse issues various types of warrants depending on the need or purpose. According to the law, the courthouse must establish a reasonable cause before giving a warrant. The requesting officer, sheriff, or police officer must present a written statement and an affidavit to the court. After investigation, the court must decide whether there are sufficient grounds to issue a warrant.

Bench Warrant

Bench warrants are legal orders for law enforcement agents to arrest persons who fail to comply with court orders. The court may give a bench warrant for various reasons, such as refusing to appear in court as a witness, failure to pay court fees and fines, and failure to respond to a court summons. When a law enforcement agent has a bench warrant, the officer may arrest the named person on the warrant as soon as the officer identifies the person. Therefore, with the bench warrant, you may be charged at any time, anywhere. It is important to note that bench warrants do not expire.

What can make a Search Warrant Invalid?

Search warrants must contain certain information. In addition, state and federal laws (the Fourth Amendment to the U.S. Constitution) require the establishment of probable reason before a judge or magistrate issues a warrant. The rules are in place to protect individuals from unreasonable searches and seizures, and violating these provisions may lead to a search warrant being invalid. Other circumstances that may lead to a search warrant becoming invalid include;

  • If the search warrant does not has a description of the property to be searched.
  • If the affidavit supporting the warrant request is insufficient
  • If the judge or issuing officer does not make copies of the search warrant
  • If the executing law enforcement officer did not provide the defendant with a copy of the warrant

Ideally, any evidence obtained from an illegal or invalid warrant may not be admissible in court as the defendant may file a case to suppress such evidence.

What can you find during a Hamilton County Arrest Warrant Search?

According to Tennessee’s Rules of Criminal Procedures, arrest warrants must contain the following information;

  • The issuing officer’s signature
  • The name of the county issuing the warrant
  • The defendant’s name or a reasonably specific description of the defendant
  • The alleged committed offense
  • An order of arrest

Authorized law enforcement agents may execute warrants anywhere in Hamilton County. When the courthouse issues a warrant for a person’s arrest, the arresting officer does not require having a physical copy of the warrant at the time of the arrest. However, the officer must inform the defendant of the reason for the arrest and offer the defendant a copy of the warrant soon.
