An arrest warrant in Washington county is a legal document that instructs the Washington County sheriff’s office to detain a person and bring them before the court. These arrest warrants are issued to arrest a suspect on a criminal investigation.

Although law enforcement agencies do not require an arrest warrant in Washington County to make an arrest when they find a criminal on the act or suspect them of a criminal offense, they cannot arrest anyone without any reason or much proof. Arrest records in Washington County allow law enforcement agencies to breach the suspect’s Fourth Amendment rights included on the arrest warrant to detain them for questioning for an ongoing investigation.

Washington County Arrest Warrant Search

Arrest warrants and records are public information under the TN Public Records Act. Any interested individual who wants to view these records may do so upon request. You can search the Washington County arrest warrants in a few places.

Magistrate’s Office

The magistrate’s office is located in the Washington County Courthouse, and it provides access to the county arrest warrants records. To search, you need to provide the name of the individual you are interested in or any other information necessary to allow search.

You can visit the office at 107 Courthouse Square, Jonesborough, TN 37659.

Clerk’s Office

The Washington County Clerk’s Office is also located in the courthouse, and unlike other government agencies, it provides access to the county arrest warrants records for free. However, it does charge for copies made. You can visit the office at any working hours and request to view their searchable database again by name, date, and type of arrest.

Sheriff’s Department

The Washington County sheriff’s office executes all court orders, including the arrest warrants. The office allows the public to view the arrest warrants page since the community helps the sheriff’s department protect the county. You can visit the office at 112 West Jackson Boulevard, Jonesborough, Tennessee 37659.

Local police departments also provide access to the county arrest warrants database since the sheriff shares the information with the other local law enforcement agencies, especially when dealing with absconders and individuals with outstanding warrants. Visit your local police department precinct at:

  • Johnson City Police Department at 601 East Main Street, Johnson, TN
  • Jonesborough Police Department at 123 Boone Street, Jonesborough, TN

Background Checks Request

Requesting a background check on your person of interest may bring search results indicating whether they have any existing arrest warrant. You can visit the TBI offices in Nashville or contact the office at (615) 744-4000 and request background check results through the mail.

You can also request these results from the county sheriff’s office. Note that you are responsible for paying service and mailing fees.

Online

Although most Washington government agencies prefer in-office visitation for you to utilize their arrest warrant databases, you can still search them online. For instance, the TBI’s most wanted individuals page is searchable by name and indicates people with outstanding arrest warrants.

Moreover, privately run and owned third-party websites provides easy lookup tools for searching arrest warrants in the county. You can choose the website of your preference and search there. Note that some websites may contain outdated information as some take very long to update their information. In addition, some may charge more than others for services or copies made.

Washington County Arrests

According to the annual summary of index crimes reported by local law enforcement agencies as part of the FBI’s Criminal Justice Information Services Division UCR Program, Washington County has an average of 1,088 index criminal crimes annually.

Most arrests in the county involve property crime, with over 600 cases of theft and 200 reported cases of burglary. On the other hand, aggravated assault is the third, and motor vehicle theft came in fourth, with 159 and 72 reports, respectively.

The least frequent offenses in the county were arson, robbery, rape, murder/manslaughter, and all other index offenses. Although various police departments and other law enforcement agencies conduct arrests and investigations, it is the county sheriff’s work to compose the county’s arrest records and arrest frequencies.

How are arrest warrants obtained in Washington County?

For an active arrest warrant, the sheriff’s office approaches the Washington County Courthouse criminal presiding judge or the magistrate and requests an arrest warrant. However, before the judge can issue the warrant, the officer must provide an affidavit indicating probable cause that explains why they need to make an arrest.

Bench warrants, on the other hand, are arrest requests made to the sheriff by the court to arrest a suspect or a witness and bring them to court. Here, the judge does not need probable cause from the sheriff’s department to issue the arrest warrant.

Other agencies, such as the Department of Human Services (DHS) or the Washington County Department of Probation and Paroles, must present their claims as to why an arrest warrant should be issued to the sheriff’s department to be executed.

When is an arrest warrant invalid in Washington County?

Although in rare cases, the court may set an expiry date for an arrest warrant. This condition is, however, only provided to the sheriff’s office, whereby the court orders the department to arrest for a given time. If they are unsuccessful, the court invalidates the warrant.

On the other hand, any wrong information on the arrest warrant deserves the arrest warrant to be nullified. Law enforcement agencies may arrest the wrong individual using a misinformed warrant.

In addition, if the probable cause used to obtain the arrest warrant was based on wrong accusations or bias, then the court is legally mandated to invalidate the warrant.
